Testimony sought in possible benzene suit

Believing her husband will soon die from cancer, Rose Soonier has filed a petition to perpetuate the testimony of her husband, Richard Soonier.

The petition was filed April 14 in Jefferson County District Court and alleges Richard was exposed to benzene during his employment with DuPont.

Possible defendants listed in the suit include Able Fastener, Brance Krachy, CRC Industries, Dow Chemical, DuPont, Ineos Chlor Americas, McJunkin-Cambar Corp., PPG Industries, Vallen Safety and Wilson Industries.

The petition claims Richard was diagnosed with lymphoma and his disease, which is allegedly the result of benzene exposure, is expected to prove fatal.

"Petitioner's reasoning for desiring to perpetuate the testimony of Richard Sonnier is that his chances of recovering ... are poor," the suit states. "As a result, petitioner has good faith belief that a gross negligence, wrongful death lawsuit will be filed."

Rose is represented by Beaumont attorney Darren Brown of the Provost & Umphrey Law Firm.

Judge Bob Wortham, 58th District Court, has been assigned to the case.
