GuardTech Pest Management recently swapped counsel in a lawsuit alleging it failed to detect a termite infestation, which ended up causing thousands of dollars worth of damage.
As previously reported, Groves residents Michael and Stacy Migues filed suit against GuardTech on Nov. 9 in Jefferson County District Court.
On March 10, Guardteck filed a motion to substitute counsel, seeking to swap Houston attorney Donald Hudgins for attorney Frank Calvert of the Beaumont law firm Calvert, Eaves, Clarke & Stelly.
Judge Donald Floyd, 172nd District Court, granted the motion that same day.
Guardtech's motion does not state what the company sought the substitution.
Court records show GuardTech performed an inspection of the plaintiffs' Groves home and allegedly "missed an active termite infestation, causing damages totaling $9,000."
The Migueses are suing GuardTech under the Deceptive Trade Practices Act, entitling them to actual damages and all court costs, including attorney's fees.
They are represented by Beaumont attorney John Morgan.
