A contract worker at the Motiva Port Arthur Crude Expansion Project has filed a lawsuit in an effort to obtain wages for time spent traveling to and from the worksite.
Claiming violations of the Fair Labor Standards Act, Robert Turner filed suit against Performance Contractors Inc. on April 11 in the Eastern District of Texas, Beaumont Division.
Turner states Performance Contractors violated federal law by not compensating its employees for their travel time to the Motiva facility. According to the lawsuit, the employees were required to report for work at a certain location and time and were then transported by bus to the Motiva facility. Each day, the time spent in transit was approximately 30 minutes, Turner claims.
The lawsuit is a collective lawsuit and hopes to represent all employees of the defendant who worked on the Motiva job from Feb. 2, 2008, until present.
The plaintiff is seeking damages for wages-owed, liquidated damages, attorney's fees, interest and court costs.
Turner is represented by The Woodlands attorney Gerald Bourque.
U.S. District Judge Marcia A. Crone is assigned to the case.
