The mother of two minor children has filed suit against her insurance company, alleging it refused to pay for injuries her children sustained in an automobile collision.
Brandy Price claims minors Katlyn and Hunter Price sustained severe and permanent bodily injuries to their faces, heads, chests, abdomens, backs and bodies after they were involved in a collision on June 4, 2006.
Although the lawsuit does not say how the accident occurred, Brandy Price claims her children experienced physical pain, suffering, mental anguish, physical impairment, disability and physical disfigurement because of it. In addition, Brandy Price incurred medical costs, according to the complaint filed May 24 in Jefferson County District Court.
At the time of the collision, Brandy Price had automobile insurance through Progressive, the suit states. She filed a claim with Progressive in hopes of obtaining reimbursement for her children's injuries. However, Progressive refused to pay Brandy Price, the complaint says.
In her complaint, Brandy Price is seeking actual and punitive damages, plus pre- and post-judgment interest at the legal rate, attorney's fees, costs and other relief the court deems just.
She will be represented by Rocky Lawdermilk of Beaumont.
The case has been assigned to Judge Milton Shuffield, 136th District Court.
