A Port Arthur woman claims she sustained shoulder, neck, head, arm, hand and body injuries after a driver failed to stop at a stop sign and slammed into her vehicle.
Mary Ann Dumas Collins filed a lawsuit May 23 in Jefferson County District Court against Juan Macedo.
In her complaint, Collins claims she drove north on Fourth Avenue in Port Arthur on Sept. 9, 2010, when Macedo, who drove east on Eighth Street, failed to obey a stop sign and struck her vehicle.
In addition to her injuries, Collins incurred medical costs; experienced mental anguish, physical pain, suffering and disability; and lost her enjoyment of life, the suit states. In addition, she suffered physical impairment, the suit states.
Collins blames Macedo for causing the accident, saying he negligently failed to control his speed, failed to maintain control of his vehicle, failed to keep a proper lookout, failed to timely apply his brakes and drove in a negligent and unsafe manner. In addition, Macedo drove inattentively and ran a stop sign, the complaint says.
In her complaint, Collins seeks damages in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.
