Hospice employee wants overtime wages for off-the-clock work

TYLER - An east Texas hospice employee is suing her employer claiming the company is failing to pay its employees overtime for time worked off the clock.

Claiming the company is violating the Fair Labor Standards Act, Judy Weedman filed suit against The Hospice of East Texas on May 20 in the Eastern District of Texas, Tyler Division.

The lawsuit accuses the defendant of failing to pay Weedman and similarly situated employees for the hours worked in excess of forty hours per week at overtime pay.

The defendant has repeatedly and consistently failed to pay for Weedman's work off the clock, which she states is an integral and indispensable to her principal activities to her continuous workday. Weedman states that her employer has paid her properly for 40 hours of work a week but does not include any pay for which she worked off the clock.

The plaintiff is asking the court for injunctive relief ordering the defendant to comply with the requirements of the FLSA and for an award of compensation due, liquidated damages, court costs and attorney's fees.

Weedman is represented by Tyler attorney Bob Whitehurst.

A jury trial is requested.

U.S. District Judge Leonard E. Davis is assigned to the case.
