Insurer sues motorist who struck pedestrian policyholder

Hoping to recoup $88,000 in benefits paid, American Home Assurance Co. has filed suit against David and Janice Pippin � the couple it holds responsible for the injury claim.

The suit was filed Aug. 25 in Jefferson County District Court.

Court records show that on Sept. 3, 2009, David Pippin was operating a vehicle owned by Janice when he struck Rommel Mendoza, who was walking in the parking lot of the Hollywood Park & Ride near State Highway 73 in Port Arthur.

Mendoza made a worker's compensation claim through his employer, Bechtel Corp., which was paid by AHA in the amount of $88,000.

The suit faults David for negligently failing to keep a proper lookout and Janice with negligent entrustment.

The plaintiff is suing for actual damages and attorney's fees.

Houston attorney Steven Hudgins represents the company.

Judge Gary Sanderson, 6oth District Court, has been assigned to the case.
