Woman sues Wal-Mart after injury to buttocks

A Kirbyville resident is suing a Jasper Wal-Mart after she injured her buttocks when she slipped and fell.

Mindy Robbins filed suit against Wal-Mart Stores Inc. on July 27 in Jasper County District Court. The defendant removed the case to the Eastern District of Texas, Beaumont Division on Aug. 31.

The incident occurred on Nov. 21, 2009 as she was shopping at a Wal-Mart in Jasper. Robbins states she injured her buttocks, back and knee when she slipped and fell in water that was on the floor near the shopping carts.

The defendant is accused of negligence for failing to keep the premises in a reasonably safe condition, inspect the premises to discover latent defects and to make safe any defects or give an adequate warning of any dangers. Robbins argues that Wal-Mart should have known that the condition of its premises created an unreasonable risk of harm to its invitees and placed warnings signs out warning of the condition.

The plaintiff is seeking damages for physical pain and suffering, mental anguish, loss of earning capacity, physical impairment, medical expenses, interest and court costs.

Robbins is represented by Tom Oxford of Waldman Smallwood in Beaumont.

U.S. District Judge Marcia A. Crone is assigned to the case.
