Trip & fall filed against funeral home

Vivian Anders and her husband, Weldon, have filed suit against the Heritage Funeral Home of Memorial Gardens, alleging the business failed to remove a tripping hazard on its premises.

The suit was filed on Aug. 31 in Jefferson County District Court and also names James Hauck Jr. as a defendant.

According to the lawsuit, on Nov. 2, 2010, Vivian tripped on the sidewalk near the funeral home.

The suit does not state how she tripped and alleges that her fall was caused by a preventable dangerous condition.

Vivian is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Her husband is seeking loss of consortium damages.

Houston attorney Wilton Chalker represents them.

Judge Gary Sanderson, 6oth District Court, has been assigned to the case.
