Beaumont resident Jacobo Nieto-Carbajal has filed suit against Mercer Transportation and one of its truck drivers, Daniel Bayless, who allegedly ran a red light and caused a collision more than four years ago.
The suit was filed Oct. 17 in Jefferson County District Court. Rodney Broussard is also a defendant in the suit.
According to the lawsuit, on July 7, 2007, Nieto-Carbajal was traveling north on Martin Luther King Jr. Parkway when Bayless, while in the course and scope of his employment with Mercer, ran a red light and caused the collision.
The suit faults Bayless with negligently failing to obey traffic laws and keep a proper lookout and also blames Mercer for negligent entrustment.
Broussard is named as a defendant in the suit because his vehicle was blocking Nieto-Carbajal's view of the intersection.
The plaintiff is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
Beaumont attorney Clay Dugas represents her.
Judge Bob Wortham, 58th District Court, is assigned to the case.
