On Monday, Nov. 14, Randal James Heier, a convicted sex offender, opted to settle with the victim he abused before a jury could be seated.
The case of Sean Bailey vs. Randal James Heier was set to go to trial, but the parties reached a $100,000 settlement.
At the age of 19, Bailey filed suit against Rebecca and Randal James Heiers in Jefferson County District Court, claiming that when he was a minor he lived near the defendants' home, where he was allegedly sexually abused.
According to Bailey's original petition, Randal Heier exposed himself and forced him to engage in inappropriate sexual conduct.
Court records show that on May 11, 2009, Randal Heier pleaded guilty to the offense of indecency with a child.
Court records also show that Bailey filed a motion to dismiss Rebecca Heir with prejudice, which was granted on Sept. 8, 2010.
Bailey was seeking damages for his mental anguish and loss of enjoyment of life.
Houston attorney Mickey Washington of Washington & Ernster represents Bailey.
Randall Heier is represented by attorney Gary Dennison.
Judge Milton Shuffield, 136th District Court, is presiding over the case.
