Encompass Indemnity sued over underinsured benefits

Claiming the benefits he received were insufficient to compensate him, Kenneth Lazard has filed suit against Encompass Indemnity for underinsured motorist benefits.

The suit was filed Nov. 14 in Jefferson County District Court.

According to the lawsuit, on May 26, 2009, Lazard was traveling north on Highway 69 in Beaumont and had slowed for a traffic when he was rear-ended by another motorist.

On Aug. 6, 2009, Encompass Indemnity, Lazard's insurance provider, was informed that he intended to claim underinsured benefits.

In his suit, Lazard claims the benefits he collected from the motorist who struck him were insufficient to compensate him for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages.

Beaumont attorney Brett Thomas of Roebuck, Thomas, Roebuck & Adams represents him.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
