Car backing out of driveway leads to lawsuit

A man has filed suit against the driver who he claims backed out of a driveway, striking his vehicle.

Charles Pace II claims he was driving on Sixth Avenue in Beaumont on Jan. 22, 2010, when defendant Richard Pastorella, who was driving a vehicle insured by defendant Laura Pastorella, backed from a driveway and struck Pace's vehicle.

Because of the collision, Pace incurred medical costs, lost his earnings and his earning capacity and sustained physical impairment, physical pain and mental anguish, according to the complaint filed Dec. 2 in Jefferson County District Court.

Richard Pastorella negligently failed to maintain proper control of his vehicle, failed to keep a proper lookout and failed yield the right-of-way, the suit states.

In his complaint, Pace is seeking an unspecified judgment, plus interest, costs and other relief the court deems just.

Jonathan C. Juhan and J.J. Bragg of Beaumont will be representing him.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
