Trucking company sued after driver changes lanes, hits vehicle

MARSHALL - A trucking company is being sued after one of its employees improperly changed lanes and struck another vehicle.

Ramona Brown and Donna R. Brown filed suit against Celadon Trucking Services Inc. and Kurt Russell Sondaker on Dec. 15 in the Eastern District of Texas, Marshall Division.

The accident occurred on April 5, 2011, on Interstate 20 in Harrison County. The Browns were traveling in a 1996 Toyota Camry when defendant Kurt Sondaker changed lanes and struck the left side of the Browns' vehicle. At the time of the collision, Sondaker was within the course and scope of his employment.

The defendants are accused of negligence for failing to keep such a lookout as would have been kept by a person exercising ordinary care and prudence, for failing to make a timely application of the brakes and for violating the Texas Transportation Code.

The Browns are asking the court for an award of damages for pain, mental anguish, physical impairment, medical expenses, interest, and court costs.

The plaintiffs are represented by Marshall attorney Jim Ammerman II.

A jury trial is requested.
