Order of dismissal entered in drunk driver suit

GALVESTON - A final order of dismissal was entered into a Pearland man's December 2010 lawsuit against a motorist from League City.

Galveston County 56th District Court Judge Lonnie Cox signed said order on Nov. 30, absolving defendant Paul Terry Young of plaintiff Ronald Bennett's claims.

Bennett sued Young, alleging the latter was drunk when he struck his vehicle as he waited at a traffic light on Feb. 27, 2010.

Court papers filed at the time say Bennett was traveling westbound in the 1400 block of W. Main Street and the intersection with N. Wesley Drive in League City when he came to a full stop.

Moments later, defendant Young "suddenly and without any warning" rear-ended Bennett and fled the scene, the original complaint says.

Police later arrested the respondent at his residence where it was discovered that he had been driving while intoxicated, the suit states.

In addition to alleged drunk driving, the defendant is blamed for operating his vehicle in a careless and reckless manner, failing to promptly apply his brakes and not keeping a proper lookout.

Young countered the claims in a 4-page original petition filed Mar. 25.

Attorney Neil S. Levin of Houston represented the defendant.
