GALVESTON - Conn's Plastering LLC has filed suit against Cypress residents Charles and Teresa Zagst in an effort to recover $5,100.
Conn's insists the couple, who own real property in Galveston, owe it for labor and materials provided toward a project at the property, a lawsuit filed Dec. 10 in Galveston County District Court states.
Court papers show the Zagsts hired Karl Hancock Enterprises Inc. as a general contractor to perform improvements to the defendants' island residence.
Hancock in turn brought Conn's in to provide the labor and materials and complete a portion of the work.
According to the original petition, the plaintiff attempted to collect the funds from Hancock, but he refused to pay.
Conn's alleges it subsequently sent required notices to Hancock and the defendants, but did not receive a cent, prompting mechanic's and materialman's liens to be filed against the property.
"The plaintiff's lien was properly and timely filed and perfected," the complaint says.
"The plaintiff is entitled to foreclose this lien on and against the property on which the improvements were constructed."
Attorney Karalynn C. Cromeens of Houston is representing the complainant, and Galveston County 10th District Court Judge David Garner is presiding over the case.
