Paint company sues over unpaid construction costs

Sherwin Williams has filed suit against the construction company that it claims failed to pay it nearly $20,000 for materials it supplied.

The Sherwin Williams Co. claims it sold defendant Lauren Moore, doing business as KLM Construction, several items on credit. However, KLM has failed to repay the $18,925.59 it owes, according to the complaint filed Dec. 12 in Jefferson County District Court.

KLM was using the materials for a job at a site in the Beaumont Independent School District. Defendant Allco had hired KLM to make improvements at the school, the suit states.

Due to the nature of the work, Allco and defendant Travelers Casualty and Surety Company of America delivered a bond promising to reimburse Sherwin Williams for any materials it supplied, the complaint says. Both they and KLM have failed to pay off their debts, Sherwin Williams claims.

In addition to the money it says it is owed, Sherwin Williams is seeking attorneys' fees, pre- and post-judgment interest, costs and other relief the court deems just.

Randall F. Adair and Daniel S. Bowns of Adair, Morris and Osborn will be representing it.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
