Store sued after woman slips and suffers injuries

A Tyler County resident has filed a personal injury lawsuit against Wal-Mart claiming she slipped and fell in a liquid substance.

Christina Theis filed suit against Wal-Mart Stores Texas on Dec. 15 in Jasper County District Court. The defendant removed the case to the Eastern District of Texas, Beaumont Division on Jan. 13.

Theis states she suffered injuries on May 23 while she was shopping at the Wal-Mart in Jasper. According to the lawsuit, she slipped on a liquid substance and injured her neck, back and wrist.

The defendant is accused of negligence for failing to warn the plaintiff of the liquid substance on the floor, for allowing the liquid substance to remain on the floor for an extended period of time, for failing to maintain the floor in a safe condition, failing to inspect the premises in order to discover the dangerous condition and for failing to remove the dangerous condition prior to Theis' injury.

She is asking the court for an award of damages for medical expenses, physical impairment, physical and mental pain, suffering and anguish, loss of earning capacity, loss of household services, disability and interest.

Theis is represented by Woodville attorney Lindsey B. Whisenhant.
