League City files suit against TWIA over unpaid claims following hurricane

GALVESTON - The city of League City alleges Texas Windstorm Insurance Association did not properly compensate it for damages received from Hurricane Ike.

A lawsuit filed Jan. 17 against TWIA in Galveston County District Court asserts the windstorm association failed to honor the city's coverage in the aftermath of the 2008 storm.

The suit states the hurricane damaged City Hall of League City and numerous other city buildings and structures.

According to the original petition, TWIA paid for a portion of the damage to the city hall building after a "significant" delay, however, most of the damages were left unaddressed.

"Further, numerous additional structures covered by this insurance policy were either ignored by TWIA's adjuster or were improperly inspected," the suit says.

"As a result, the city has not been properly compensated under the terms of its insurance policy."

The complainant summarily insists that the windstorm association "wrongfully denied the plaintiff's claim for repairs of the property even though the policy provided coverage for losses such as those suffered by the plaintiff."

A jury trial is requested.

The Tylka Law Firm and The Mostyn Law Firm are representing the city, and Galveston County 10th District Court Judge David Garner is presiding over the case.
