Auto crash in Dickinson subject of lawsuit

GALVESTON - Joseph and Revetta Wilcox have filed suit over an auto crash with Jose O. Reyes, recent court documents say.

A lawsuit filed Jan. 18 in Galveston County District Court alleges Reyes backed a white 2003 Nissan truck into a blue 2004 Ford F150 carrying the plaintiffs on Oct. 6, 2011.

The suit shows Joseph E. Wilcox drove the Ford westbound on Hughes Road in Dickinson when he collided with Reyes, who was reportedly making a delivery in the vicinity.

"The defendant passed Forest Cove and turned onto Desel Drive," the original petition says.

"The defendant then began backing up and onto Hughes Road from Desel Drive, failing to yield the right-of-way to the plaintiff on Hughes Road."

The Wilcoxes say their vehicle was damaged upon impact and they received "severe, disabling" injuries.

They blame Reyes for failing to yield the right-of-way, failing to keep a proper lookout, failing to safely back onto the roadway, failing to take proper evasive action and failing to act as a prudent driver.

Houston resident William D. Benavides is a defendant in the case because he allegedly entrusted the Nissan truck to Reyes.

Consequently, the plaintiffs seek unspecified monetary damages and a jury trial.

They are represented by Bettison, Doyle, Apffel & Guarino.

Galveston County 212th District Court Judge Susan Criss is presiding over the case.
