Materials company seeks $20K for disaster service

A Hopkins County company has filed suit against the global disaster agency that it claims has failed to repay it more than $20,000 for services it performed.

Pinnacle Materials claims it agreed to haul material, machinery and supplies used by defendant Global Disaster Services after Global Disaster completed a credit application.

After it possessed the completed credit application, Pinnacle hauled six frac trucks and a water pump for Global Disaster to a gas well in Zavala County, according to the complaint filed Feb. 21 in Jefferson County District Court.

Although Pinnacle performed all of the agreed-upon work, Global Disaster refused to pay it for its services, the suit states.

"The amount past due and outstanding to Pinnacle is $23,195.86," the complaint says.

In its complaint, Pinnacle alleges breach of contract and misapplication of construction trust funds against Global Disaster.

Pinnacle also names Albert J. Isakson as a defendant, saying he signed a guaranty, promising to pay Pinnacle the money owed by Global Disaster if Global Disaster defaulted on its payments. However, Isakson has also refused to reimburse Pinnacle, according to the complaint. It alleges misapplication of construction trust funds against Isakson, also.

In its complaint, Pinnacle is seeking actual damages, pre- and post-judgment interest, costs, attorneys' fees and other relief the court deems just.
