Passenger sues over I-10 wreck

A Harris County man claims he sustained numerous injuries after a driver suddenly changed lanes and struck the vehicle in which he rode.

Robert L. Johnson filed a lawsuit March 9 in Jefferson County District Court against Leslie K. Smith.

In his complaint, Johnson alleges he was riding in a vehicle his wife was driving on Interstate 10 in Beaumont on March 16, 2010, when Smith came into his lane and struck the vehicle in which Johnson was riding.

In addition to his injuries, Johnson experienced physical pain, mental anguish and physical impairment and incurred medical costs, according to the complaint. He also lost wages, the suit states.

Johnson blames Smith for causing the collision, saying she negligently failed to keep a proper lookout, failed to timely apply her brakes, failed to swerve to avoid a collision, failed to drive in a reasonable manner and failed to control her speed.

In his complaint, Johnson seeks a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest at the legal rate, costs and other relief the court deems just.

Jack Todd Ivey and Jacob D. Barber of Ivey Law Firm in Houston will be representing him.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
