While out shopping at a Port Arthur Wal-Mart, Montgomery County resident Patrick Donley stepped in some paint and slipped.
Alleging he injured himself in the fall, Donley filed suit against the mega-retailer on March 30 in Jefferson County District Court.
According to the lawsuit, on June 30, 2010, Donley was shopping in the paint department when he slipped and fell on paint leaking underneath the shelves in the next aisle.
The suit accuses Wal-Mart of negligently failing to maintain the premises and warn of the danger.
The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
Houston attorney Nataliya Kharmats of Young & Husain represents the plaintiff.
Judge Donald Floyd, 172nd District Court, is assigned to the case.
