Alleging a runaway-shopping cart struck her vehicle and injured her, Mary Garner has filed suit against Wal-Mart Stores.
The suit was filed April 23 in Jefferson County District Court and also names store manager Kim Thibodeaux as a defendant.
According to the lawsuit, on April 22, 2010, Garner was traveling north on the Interstate 10 feeder road when a shopping cart owned by the Beaumont Wal-Mart rolled across the parking lot until entering the roadway and striking her vehicle.
The suit alleges the defendants negligently failed to conduct routine inspections of the parking lot and secure all loose carts.
Garner alleges she suffered permanent and disfiguring injuries in the collision with the shopping cart.
She is also seeking damages for her mental anguish and medical expenses.
Judge Milton Shuffield, 136th District Court, is assigned to the case.
