Beaumont resident Craig Madigan is suing Bean, Sand & Gravel and one of its employees, Harry Andrews, who allegedly changed lanes and struck his vehicle, sending him flying across to lanes of traffic.
The suit was filed May 21 in Jefferson County District Court.
According to the lawsuit, on Sept. 26 Madigan was traveling south on Highway 69 in Nederland when Andrews, while acting in the course of scope of his employment with BS&G, failed to drive in a single lane and struck his vehicle.
The collision caused Madigan's vehicle to roll over several times down an embankment and across two lanes of traffic before coming to a stop in the grass, the suit states.
The suit further accuses Andrews of negligently failing to maintain a proper lookout and BS&G of negligently training him.
The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
Beaumont attorney Clay Dugas represents him.
Judge Donald Floyd, 172nd District Court, is assigned to the case.
