Polk County woman sues Wal-Mart after slipping and falling in water

LUFKIN - After slipping in water and falling, a Polk County woman is suing her local Wal-Mart for failing to maintain the store.

Judith L. Weese filed suit against Wal-Mart Stores Texas on April 27 in Polk County District Court. The defendant removed the case to the Eastern District of Texas, Lufkin Division on May 29.

The incident occurred on Feb. 4 as Weese was shopping at the Wal-Mart located in Polk County. Weese states that water left on the floor caused her to fall, according to the suit.

The defendant is accused of negligence for the maintenance of the premises and of the aisle in question, failing to properly and adequately warn members of the public of the dangers inherent in the premises and in failing to properly and adequately supervise the usage of the premises and for failing to properly inspect and maintain the premises.

The plaintiff is seeking an award of damages for physical pain and mental anguish, physical impairment, disfigurement, loss of wage earning capacity, medical expenses, interest, medical expenses, interest and court costs.
