A new discovery control plan order was recently entered in a slip-and-fall lawsuit against BNSF Railroad, bumping the case from its previously slated summer trial date to January.
Schlonda Donald filed suit against BNSF on May 13, 2011, in Jefferson County District Court, alleging she slipped on water leaking from a BNSF pipe.
Court records show that the original plan order was entered Jan. 6, calling for all discovery to be conducted by May 31 and for the case to mediated on or before June 30 or go to trial in July.
However, on March 26 Judge Bob Wortham, 58th District Court, granted an agreed motion for continuance, allowing more time for discovery.
On May 7 a new plan order was entered, slating the case for a January 2013 trial, court papers say.
The lawsuit states that on June 20, 2009, Donald, a Renzenberger Inc. employee, claims she slipped and fell because of water leaking from a damaged BNSF pipe. She was in the company's break room at the time of the incident.
The suit alleges BNSF negligently failed to fix the pipe, warn her of the dangers or train its employees.
Donald is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
