Construction company says man's own negligence led to his fatal fall

GALVESTON - The employer of a man who allegedly died from injuries suffered during a fall at the Tiki Island fire station has submitted a formal response to legal action against it, recent court records show.

JC Stonewall Constructors is facing a wrongful death lawsuit from Elodia Michaca Trujillo, who claims the business did nothing to prevent her son, Salvador Meza, from falling off metal cross beams at the job site of the fire station on Nov. 12, 2011.

The suit, filed May 3 before the Galveston County 122nd District Court, claims Meza "lost his balance and fell over 14 feet to the concrete ground below" and died three days later. The suit alleges he fell because JC Stonewall Constructors failed to provide proper fall protection and preventative equipment.

In a four-page original answer entered May 25, the defendant shows "that the decedent, Salvador Meza, was negligent and is at fault for causing this tragic and unfortunate accident and his ensuing death."

The defendant also insists "that it was neither negligent nor a proximate cause of this accident in question," stating the subject events were caused "solely or partially" by third parties it has no control over.
