A woman has filed suit against the driver who she claims failed to yield the right-of-way at an intersection, causing a collision.
Stefanie Defrates claims she was driving east in the 8300 block of Folsom Road on Aug. 26, 2011, and waiting on a light to turn green so she could execute a southbound turn.
After Defrates's light switched, she began to proceed through the intersection when defendant Dee Ann Whittington failed to obey her traffic control device and struck Defrates's vehicle, according to the complaint filed June 7 in Jefferson County District Court.
Because of the collision, Defrates incurred medical costs and experienced physical pain, suffering, physical impairment and mental anguish, the suit states.
Whittington negligently failed to keep a proper lookout, failed to stop at a traffic control device and failed to grant use of the intersection to the defendants, the complaint says.
Defrates is seeking a judgment in excess of the minimum judgment of Jefferson County District Court, plus pre- and post-judgment interest, costs and other relief the court deems just.
She will be represented by J. Trenton Bond and Chris M. Portner of Portner and Bond in Beaumont.
The case has been assigned to Judge Bob Wortham, 58th District Court.
