Burton Mart Inc. has filed suit against Shujat Holding Co., alleging the defendant sold a convenience store to the plaintiff but never tendered the property.
The suit was filed June 19 in Jefferson County District Court.
According to the lawsuit, the parties entered into an agreement for sale of Gator Shop No. 4, located in Port Neches.
"After plaintiff paid and provided substantial consideration to defendant, defendant refused to tender the property to defendant," the suit states.
Burton Mart claims Shujat Holding breached its contract and committed fraud.
The plaintiff is suing for actual and exemplary damages.
Beaumont attorney Chris Portner of Portner Bond represents it.
Judge Donald Floyd, 172nd District Court, is assigned to the case.
