Bank sues over delinquent payments on manufactured home

A bank has filed suit against the two Call residents who it claims have defaulted on payments toward their manufactured home.

Communitybank of Texas claims it held a contract that defendants Kenneth and Kendra Ferguson executed on Nov. 24, 2003, for the purchase of a manufactured home. The contract was worth $20,800, according to the complaint filed July 3 in Jefferson County District Court.

"As of April 16, 2012, defendants were delinquent in the payment of five installments of $267.08 each on the contract and delinquent in procuring and producing a valid and current copy of a hazard insurance policy to the plaintiff," the suit states.

Although Communitybank gave the Fergusons notice of their delinquency, they have failed to make the required payments, the complaint says.

In addition to the money it says the Fergusons owe it, Communitybank is seeking pre-judgment interest, attorney's fees, costs, post-judgment interest, foreclosure against the property and other relief the court deems just.

It will be represented by April C. Lindsay of Lindsay, Lindsay and Parsons in Beaumont.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
