An agreed final judgment has been entered in a suit claiming the plaintiff was injured when a van took off before he was completely seated.
As previously reported, Shuron Hubert filed suit against BNSF Railway and Renzenberger Inc. on Jan. 27, 2011, in Jefferson County District Court.
The agreed final judgment was filed April 9 and states the parties have reached a settlement.
The case was set for a preferential trial setting on May 7, court records show.
The suit alleges that on Dec. 25, 2010, Hubert, a BNSF Railway employee, entered a van owned by Renzenberger when it suddenly accelerated. Hubert was able to hang on but injured his back in the process.
Renzenberger was hired by BNSF to transport employees to a work site, court papers say.
In response to the suit, both defendants filed answers asserting contributory negligence, court records show.
Hubert was seeking monetary and punitive damages, pre- and post-judgment interest, costs and other relief the court deems just.
