Man standing by parked vehicle settles with driver who struck him

Before a jury could be selected Monday, a Beaumont man settled his suit against the driver who allegedly struck him as he stood near a parked vehicle.

According to the lawsuit filed Feb. 24, 2010, in Jefferson County District Court, Benjamin Alvarado claims he was struck by defendant Matthew Falgout on March 18, 2008, in Beaumont after Falgout failed to safely move his parked vehicle.

The case was slated to go to trial on Monday, July 23 in Judge Gary Sanderson's 60th District Court.

However, a court official told the Southeast Texas Record that the parties reached a settlement beforehand.

The suit alleged Falgout negligently failed to keep a proper lookout and drove with disregard for the safety of others.

Alvarado was seeking damages for his medical costs, lost earnings, physical impairment, physical pain and mental anguish.
