A Beaumont woman claims she sustained back and neck injuries after an allegedly intoxicated driver struck the back of the parked vehicle in which she was sitting.
Addison August filed a lawsuit July 9 in Jefferson County District Court against Lawrence Madaffri.
In her complaint, August claims she was sitting in a vehicle parked in front of 960 Chamberlin when Madaffri rear-ended the vehicle.
In addition to her injuries, August incurred medical bills; experienced mental anguish, physical pain, suffering and disability; and lost her enjoyment of life, according to the complaint. She also lost her earning capacity and sustained physical impairment, the suit states.
August blames Madaffri for causing the collision, saying he negligently failed to maintain control of his vehicle, failed to keep a proper lookout, failed to timely apply his brakes, failed to drive within a single lane, drove while intoxicated and drove inattentively.
In her complaint, August seeks actual damages, plus costs, pre- and post-judgment interest at the maximum rate allowed by law and other relief the court deems just.
Clay Dugas of Beaumont will be representing her.
Judge Bob Wortham, 58th District Court, has been assigned to the case.
