Capital One Bank has filed suit against Beaumont resident Darrell L. Wheeler, alleging he owes more than $12,000 on a delinquent credit account.
The suit was filed Aug. 7 in Jefferson County District Court.
In its suit, Capital One asserts the defendant entered into a credit account agreement with the bank, advancing dollar amounts that the defendant became obligated to pay.
The suit does not state when the account was opened or for what purposes, but does state that the defendant ceased making payments on the account, thereby creating a default.
On May 3 Capital One claims it sent a letter demanding payment but the defendant still refuses to repay the debt, according to the suit.
The amount due and owing on the account is $12,480.17 as of July 13, the suit states.
"Defendant has presented its claim to defendant for payment, by defendant has failed and refused to pay the amount owed," the suit states.
Capital One is suing for actual damages, interest court costs and attorney's fees.
Carrollton attorney Michael Scott represents the lender.
Judge Bob Wortham, 58th District Court, has been assigned to the case.
