A new scheduling ordering has been entered in litigation brought by Dana Falcon, a Market Basket employee who was alleges she was injured when an oven exploded.

As previously reported, Falcon filed an application for injunctive relief against TSTL Investments, doing business as Market Basket No. 2, on June 21, 2011, in Jefferson County District Court.

Court records show that on Jan. 10 a discovery control plan order was entered in the suit, calling for the case to be meditated before July 31 or face an August trial.

However, on July 16 the parties filed an agreed motion for continuance, stating the parties need more time for discovery and to continue negotiations.

Two days later, Judge Bob Wortham, 58th District Court, signed off on a new scheduling order, rescheduling the trial for December, court papers say.

According to the original petition, on June 5, 2011, Falcon was injured while working for the store when a commercial oven exploded.

Dallas attorney Kimberly P. Charter represents the defendant.
