USAA sues Beaumont man for causing collision with insured

As subrogee of Kayla Hawkins, USAA Casualty Insurance has filed suit against Beaumont local Hien Nong, seeking to recover benefits paid to its insured after a vehicle collision.

The suit was filed Aug. 10 in Jefferson County District Court.

According to the petition, on Dec. 25, 2011, USAA's insured driver, Hawkins, was driving southbound on Eastex Freeway in Beaumont when Nong failed to drive in a single lane and caused an automobile collision.

"As a result ... of defendant's negligence, Ms. Hawkins' vehicle sustained damage," the suit states. "Plaintiff files this suit to recover losses sustained pursuant to an insurance contract with Hawkins."

The suit further accuses the defendant of negligently failing to yield the right of way, change lanes safely and apply his brakes in a timely manner.

USAA is suing for actual damages in the amount of $10,268.90, plus interest and all court costs, including attorney's fees.

Houston attorney Charles Kelly of Kelly, Smith & Murrah represents the plaintiff.

Judge Bob Wortham, 58th District Court, is assigned to the case.
