Judice’s French Market non-suited from trip & fall

Mary Braziel, who sued Judice’s French Market & Deli after tripping on a “dangerous” rug while shopping, recently non-suited the defendant.

As previously reported, the suit was filed May 24, 2011, in Jefferson County District Court.

Court records show that on Jan. 6 a discovery control plan order was filed, setting the case on the court’s July trial docket.

However, a month before the slated trial, Braziel filed a notice of non-suit on June 8, court papers say.

That same day, Judge Bob Wortham, 58th District Court, dismissed Judice’s French Market with prejudice.

The lawsuit alleges that on Nov. 17, 2009, Braziel was shopping at the Port Arthur store. She was walking through the meat isle when she tripped on the rug.

Judice’s French Market negligently failed to inspect and maintain its premises, warn shoppers of dangerous condition and remedy the hazard, the suit alleges.

Braziel was suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
