Chambers County residents sue over car crash

Two Chambers County residents have filed suit against the driver who they claim failed to yield the right-of-way when turning, causing a collision.

Billy McDaniel and Earnest Rives allege they were driving north on Highway 82 on July 20 when defendant Dale Roach failed to yield the right-of-way and turned in front of their vehicle, causing a collision.

Because of the accident, McDaniel and Rives incurred medical costs; experienced mental anguish, physical pain, suffering, disability and physical impairment; and lost wages, according to the complaint filed Sept. 5 in Jefferson County District Court. They also lost their earning capacities and incurred property damages, the suit states.

Roach negligently failed to yield the right-of-way, failed to control his speed, drove inattentively and drove while distracted, the complaint says.

McDaniel and Rives are seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.

Clay Dugas and Reginald Blakeley of Beaumont will be representing them.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
