While standing up on a travel bus to throw away some trash, Roger Holland stumbled and fell when the vehicle stopped at a traffic light.

On Sept. 24 Holland and his wife Daisy filed suit against the bus company, Brazos Valley Travel, and the driver, Christine Dorsett, in Jefferson County District Court.

According to the lawsuit, on May 7, 2011, the couple was on a bus returning from Florida back to Lufkin when Holland left his seat to throw away some trash.

The bus came to a signal light on Highway 105 in Beaumont and Dorsett allegedly slammed on her brakes, causing Holland to stumble forward and hit his face on the dash area and fall down.

The suit alleges Dorsett negligently failed to keep a proper lookout and also operated the vehicle in a reckless manner.

Brazos Valley Travel is faulted with negligent entrustment.

The Hollands are suing for their loss of consortium and for Roger’s alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Lufkin attorney Larry Byrd of Williams & Byrd represents them.

Judge Milton Shuffield, 136th District Court, is assigned to the case.

Case No. D193-203
