Tractor-trailer driver sued for causing wreck by failing to yield right of way

LUFKIN - A Nacogdoches woman has filed a lawsuit against the tractor-truck driver who allegedly caused a wreck by failing to yield the right of way and turning into her vehicle. 

Moniqua Thomas filed suit against Lashonda Denise Combs and T. K. Stanley Inc. on Sept. 27, 2011 in Nacogdoches County Court. The defendants removed the case to the Eastern District of Texas, Lufkin Division on Sept. 27.

The accident occurred on Sept. 7, 2011, as Thomas was driving her 2001 Mercury Mountaineer vehicle on Stallings Drive in Nacogdoches when defendant Combs collided into her vehicle. Combs was driving a 2008 Mack truck/tractor and towing a truck.

According to the lawsuit, defendant Combs was attempting to enter onto Stallings Drive when she collided into Thomas’ vehicle. At the time of the wreck, Combs was working for the defendant T. K. Stanley.

The defendants are accused of negligence for failing to yield the right of way, failing to yield the and grant immediate use of the intersection, failing to properly apply the brakes in order to avoid the collision, failing to maintain an assured clear distance between her vehicle and Thomas’ vehicle, failing to keep a proper lookout, attempting to turn left when it could not be done with safety and for driving in a reckless manner.

The plaintiff is seeking damages for physical pain, suffering, mental anguish, medical bills, physical impairment, loss of earnings, loss of earning capacity and interest.

Thomas is represented by Jeff B. Badders of Badders Law Firm in Nacogdoches. A jury trial is requested.
