A woman injured while working out is suing the gym for allowing overcrowding in the training area.
Veronica Wimberley filed suit against Transformation Challenge Physical Training, Luis Valdez and Joe Dominguez on Sept. 28 in Jefferson County District Court.
According to the lawsuit, on June 5 Wimberley was a patron at the defendants’ Nederland premises, a boot-camp style physical training facility.
During a training session, Wimberley claims she suffered unspecified bodily injuries caused by a dangerous condition that the defendants should have known existed.
The suit does not say how Wimberley was injured or specify what dangerous condition caused her alleged injuries.
The suit only accuses the defendants of negligently failing to maintain the floor in a safe manner, allowing overcrowding in the training area, failing to warn of the danger and failing to identify and correct the unspecified dangerous condition.
The plaintiff is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
Adam Terrell of Weller, Green, Toups and Terrell in Beaumont represents her.
Judge Gary Sanderson, 6oth District Court, is assigned to the case.
