American Express sues card member over delinquent account

Seeking to recover more than $18,000 on a delinquent account, American Express Bank has filed suit against Beaumont local Lydia Ramirez. 

According to the lawsuit, the parties entered into a card member agreement, in which American Express made cash advances to Ramirez.

The suit does not state when the agreement was agreed upon.

“Defendant has failed to repay all of the advances made under the agreement,” the suit states. “The current balance due … totals $18,187.74.”

The suit accuses Ramirez of breaching her contract and unjust enrichment.

American Express is suing for actual damages, interest and attorney’s fees in the amount of $5,000.

Houston attorney Donald DeGrasse of Degrasse & Rolnick represents the plaintiff.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
