Nationwide Mutual Insurance has non-suited James O’Neal from litigation filed in June.
Seeking to recover money paid to its insured, Nationwide, as subrogee of Jimmy Salanga, sued O’Neal for causing an automobile collision last December.
As previously reported, the suit was filed June 19 in Jefferson County District Court.
Court records show that on Sept. 17 Nationwide filed a notice of non-suit, stating that it no longer wished to pursue the matter.
On Sept. 24 Judge Donald Floyd, 172nd District Court, dismissed O’Neal from the claim with prejudice.
The lawsuit alleged that on Dec. 28, 2011, O’Neal was traveling east on US Highway 73 in Port Arthur when he struck a vehicle driven by Salanga.
The suit accused O’Neal of negligently failing to control his vehicle and speed.
Nationwide was suing for actual damages in the amount of $8,883.41, plus court costs.
