A development company is seeking a default judgment against an evicted tenant.
As previously reported, Varner Development filed suit against the owners of Surfside Flooring, Charles Ehrhardt, Kathy Ehrhardt and Christopher Ehrhardt, on May 15 in Jefferson County District Court.
Court records show that on Oct. 16 Varner filed a motion for default judgment, asserting that the defendants have failed to appear and answer the suit within the time allowed by the law.
The lawsuit alleges that on Nov. 1, 2010, Varner entered into an agreement with Surfside to lease property on Crystal Beach.
“Surfside Flooring failed to pay rent, abandoned the property and was subsequently evicted,” the suit states, adding that the defendants failed to honor their contract.
Varner is suing for actual damages and attorney’s fees.
Beaumont attorney Chris Portner of Portner Bond represents the company.
Judge Donald Floyd, 172nd District Court, is assigned to the case.
