Baptist Hospitals of Southeast Texas is suing Reytec Construction Resources, alleging the company left a mound of dirt in its parking lot after a lease with the hospital expired.
The suit was filed on Oct. 17 in Jefferson County District Court.
According to the lawsuit, on Feb. 28, 2010, the parties entered into a 1-year lease agreement for land and a parking area on Baptist hospital's campus.
“Defendant used the property for the storage of construction equipment and materials in connection with … a project for the city of Beaumont,” the suit states.
“While most of the equipment was removed … defendant failed to remove an enormous pile of dirt … and failed to return more than 100 parking stops.”
A Beaumont fire marshal told Baptist the dirt contains hazardous substances, the suit states.
Despite demand, Reytec Construction refused to remove the dirt, forcing Baptist to restore the lot at its own expense for a cost of $100,000.
The suit accuses Reytec Construction of breaching its contract.
Baptist is suing for actual and consequential damages, plus attorney’s fees.
Attorney Mary-Olga Lovett of the Houston law firm Greenberg Traurig represents Baptist.
Judge Gary Sanderson, 6oth District Court, is assigned to the case.
