A man has filed suit against the driver who he claims failed to maintain a proper lookout, causing a collision.
Brett Nicholson claims he was driving on May 6 when defendant Carly Andrews failed to yield the right-of-way at a stop sign and collided with Nicholson.
Because of the collision, Nicholson experienced physical pain and mental anguish, endured a damaged earning capacity and sustained disfigurement, according to the complaint. He also experienced physical impairment and incurred medical costs, the suit states.
Andrews negligently failed to keep a proper lookout, failed to timely apply her brakes, failed to drive safely, failed to yield the right-of-way and failed to maintain control of her vehicle, the complaint says.
In his complaint, Nicholson is seeking actual, punitive and exemplary damages, plus pre- and post-judgment interest, costs and other relief the court deems just.
