The owner of a Jefferson County manufactured home faces foreclosure after he failed to timely make monthly mortgage payments, according to recently filed court documents.
Vanderbilt Mortgage and Finance filed a lawsuit Nov. 1 in Jefferson County District Court against James H. Huff.
In its complaint, Vanderbilt alleges it lent $80,464.80 to Huff so he could buy his manufactured home on Amanda Lane in China.
The mortgage was to be repaid in 240 monthly payments of $335.27, according to the complaint. However, Huff defaulted on payments beginning in July, the suit states. Although Vanderbilt has demanded reimbursement, Huff has failed to repay the company, the complaint says.
“As of October 22, 2012, the unpaid balance of defendant’s debt is $25,016.42,” the suit states.
In addition to the money it says Huff owes it, Vanderbilt seeks pre-judgment interest of 9.5 percent per annum, foreclosure of the security interest in the home, costs, attorney’s fees, post-judgment interest at the maximum rate allowed by law and other relief the court deems just.
