Defendant responds to discovery request in suit brought by injured moped driver

Defendant Gialam Tran has responsed to discovery requests in litigation brought by Larry Penn, who was forced to lay down his moped to avoid a collision after Tran allegedly ran a stop sign.

As previously reported, on May 17 Penn filed suit against Tran in Jefferson County District Court.

Court records say that on Nov. 9 a certificate of discovery was filed showing Tran responded to Penn’s interrogatories and request for production.

The lawsuit alleges that on Jan. 28 Tran allegedly failed to yield the right of way at a stop sign, forcing Penn to lay down his moped to avoid striking him.

The suit does not state where the incident occurred.

Tran is accused of negligently failing to maintain a proper lookout and apply his brakes in a timely manner.

Penn is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Beaumont attorney David Wilson of Provost Umphrey represents him.

Tran is represented by attorney Richard Hatfield of the Beaumont law firm Harris, Duesler & Hatfield.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
