A mortgage company has filed suit against the Beaumont man who it claims failed to timely make his mortgage payments.
21st Mortgage Corp. claims it lent an unspecified amount of money to defendant Wayne Rose. To secure the contract, Rose entered into a security agreement, granting an interest in his 2009 Legacy Housing manufactured home, according to the complaint filed Nov. 16 in Jefferson County District Court.
Since then, Rose defaulted on his monthly payments and owes 21st Mortgage Corp. $32,360.38, the suit states.
“On October 26, 2012, the arrears in monthly payments were the sum of $2,232.53,” the complaint says.
Because of Rose’s failure to make payments, 21st Mortgage Corp. claims Rose is obligated to peacefully handover the manufactured home in the security agreement. However, he refuses to do so, according to the complaint.
In its complaint, 21st Mortgage Corp. is seeking the money it says it is owed, plus $1,500 in attorneys’ fees, costs, post-judgment interest at the highest rate allowed by law, an order that a sheriff seize the property in question and other relief the court deems just.
